District Public Prosecutor’s Office

The competence of District Public Prosecutor’s Offices corresponds in material aspects to the competence of District Courts. The District Public Prosecutor’s Offices operate in the jurisdiction of District Courts, unless a special legal enactment stipulates otherwise. In the jurisdiction of the capital city of Prague the competence of District Public Prosecutor’s Offices is exercised by Circuit Public Prosecutor’s Office and in the jurisdiction of the city of Brno the jurisdiction of the District Public Prosecutor’s Office is exercised by the Metropolitan Public Prosecutor’s Office in Brno. The public prosecutors of these Public Prosecutor’s Offices represent public suit in proceedings conducted before District Courts as the courts of the first instance.

 

 

Regional Public Prosecutor’s Office

Similarly, the competence of Regional Public Prosecutor’s Offices corresponds to the competence of Regional Courts. Regional Public Prosecutor’s Offices operate in the jurisdiction of Regional Courts, unless stipulated otherwise. In the jurisdiction of the capital city of Prague the competence of the Regional Public Prosecutor’s Office is exercised by the Metropolitan Public Prosecutor’s Office in Prague. The Public Prosecutors of these Public Prosecutor’s Offices represent the public suit in proceedings conducted before the Regional Courts as courts of the first or second instance, if they decide on appeals and complaints against decisions of District Courts. Regional Public Prosecutor’s Offices also operate as the basic link of handling incentives to file complaints against the breach of law in criminal matters and in the course of reviewing criminal cases of its own initiative. Regional Public Prosecutor’s Offices perform supervision over the activity of District Public Prosecutor’s Offices.

 

 

High Public Prosecutor’s Office

The competence of High Public Prosecutor’s Offices corresponds in material aspects to the competence of High Courts. The seat of the High Court in Prague is the capital city of Prague and the seat of the High Court in Olomouc is the city of Olomouc. The High Public Prosecutor’s Office engages in proceedings on regular legal remedies against decisions made by Regional Courts as the courts of the first instance. The High Public Prosecutor’s Office also engages in handling incentives to file complaints against the breach of law in criminal matters and in the course of reviewing criminal cases of its own initiative. The High Public Prosecutor’s Offices perform supervision over the activity of Regional Public Prosecutor’s Offices. There are special Departments of Serious Economic and financial Crime established at the High Public Prosecutor’s Offices.

 

Supreme Public Prosecutor’s Office

The Competence of the Supreme Public Prosecutor’s Office in Brno is in compliance with the competence of the Supreme Court. The Supreme Public Prosecutor’s Office also performs supervision over the activity of High Public Prosecutor’s Offices, it engages in handling incentives to file complaints against the breach of law in criminal matters and in the course of reviewing criminal cases of its own initiative. Furthermore, the Supreme Public Prosecutor’s Office issues recommendatory opinions that deal with specific application issues the public prosecutors encounter in practice, both in criminal and non-criminal area.

 

Supreme Public Prosecutor’s Office engages in issuing decisions and opinions for the interpretation of laws and other legal enactments, which are published in the Collection of Judicial Decisions and Opinions, or in cases where a certain legal issue requires harmonization of interpretation or in cases where there have been contradictory decisions of lower Courts, also in the matter of cases relating to multiple senates of the Supreme Court or disputable issues in between the senates, in proceedings on recognition and enforceability of foreign court decisions in the territory of the Czech Republic, if a special Act or international treaty so requires. The Supreme Public Prosecutor’s Office is represented in Eurojust and is a member of the General Prosecutor’s Network of the European Union.
